Pursuant to suspension of Senate Rule 11.18, a public hearing of
the Standing Senate Subcommittee on Higher Education was held on
Tuesday, April 5, 2005, in the Senate Chamber at Austin, Texas.

The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 132, SB 315, SB 333, SB 801, SB 936, SB
1226, SB 1247, SB 1643.
There was no action taken for the following bill(s): SB 1643.
The chair called the meeting to order at 1:28 p.m. There being
a quorum present, the following business was transacted:
Senator Staples assumed the chair.
The chair laid out SB 333 and recognized the author, Senator
West, to explain the bill. Senator West moved that SB 333 be
reported favorably to the Full Committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 6 ayes, 0 nay, 0 present not voting, and 0
absent.
The chair laid out SB 936 and recognized the author, Senator
West, to explain the bill. Senator West sent up a committee
substitute; the chair recognized Senator West to explain the
difference between the committee substitute and the bill as
filed. Senator West moved adoption of the committee substitute;
without objection, it was so ordered. Senator West moved that
SB 936 do not pass but that CSSB 936 be reported back to the
Full Committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 6 ayes, 0
nay, 0 present not voting, and 0 absent.
Senator West resumed the chair.
The chair laid out SB 132. Senator Staples sent up a committee
substitute. Senate Staples moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Staples moved that SB 132 do not pass but that CSSB 132 be
reported back to the Full Committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 5 ayes, 0 nay, 0 present not voting, and 1 absent.
The chair laid out SB 315. Senator Staples moved that SB 315 be
reported favorably to the Full Committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 4 ayes, 0 nay, 0 present not voting, and 2
absent.
The chair laid out SB 801. Senator Staples sent up a committee
substitute. Senator Staples moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Staples moved that SB 801 do not pass but that CSSB 801 be
reported back to the Full Committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 6 ayes, 0 nay, 0 present not voting, and 0 absent.
The chair laid out SB 1226. Senator Averitt sent up Committee
Amendment 1 and moved adoption; without objection, the amendment
was adopted. Senator Averitt moved that SB 1226, as amended, be
reported back to the Full Committee with the recommendation that
it do pass and be printed. The motion carried with a record
vote of 6 ayes, 0 nay, 0 present not voting, and 0 absent.
Senator Averitt assumed the chair.
The chair laid out SB 1247. Senator West moved that SB 1247 be
reported favorably to the Full Committee with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 6 ayes, 0 nay, 0 present not voting, and 0
absent.
Senator West resumed the chair.
Senator Williams requested unanimous consent to be shown as
voting "aye" on the following bills: SB 333, CSSB 936, CSSB 801.
Without objection, it was so ordered.
There being no further business, at 1:40 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
chair. Without objection, it was so ordered.
