         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Higher Education was held on Monday, April 11, 2005, in the  
         Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

         Senator Averitt called the meeting to order at 4:18 p.m.  The  
         following business was transacted:   
          
         The chair laid out SB 722 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Averitt moved that SB 722  
         be left pending; without objection, it was so ordered.   
          
         The chair laid out SB 39 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Averitt moved that SB 39 and the committee substitute be  
         left pending; without objection, it was so ordered.   
          
         The chair laid out SB 1227 and recognized the author, Senator  
         Shapiro, to explain the bill.  Senator Averitt sent up a  
         committee substitute; the chair recognized Senator Shapiro to  
         explain the difference between the committee substitute and the  
         bill as filed.   
          
         At 4:45 p.m. Senator West resumed the chair.   
          
         Witnesses testifying and registering on SB 1227 are shown on the  
         attached list.  The chair moved that the public testimony be  
  
         closed; without objection, it was so ordered.  Senator West  
         moved that SB 1227 and the committee substitute be left pending;  
         without objection, it was so ordered.   
          
         At 4:48 p.m. Senator Averitt assumed the chair.   
          
         The chair laid out SB 817 and recognized the author, Senator  
         West, to explain the bill.  Senator West sent up a committee  
         substitute; the chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection,; without objection, the  
         amendment was adopted.   it was so ordered.  Senator West sent  
         up Committee Amendment 1. Senator Averitt moved that SB 817, the  
         committee substitute, and Committee Amendment 1 be left pending;  
         without objection, it was so ordered.   
          
         At 5:13 p.m. Senator West resumed the chair.   
          
         The chair laid out SB 1529 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator West moved that SB 1529 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB 95 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Senator West sent up Committee  
         Amendment 1. The chair opened public testimony; there being no  
         witness cards, public testimony was closed.  Senator West moved  
         that SB 95 and Committee Amendment 1 be left pending; without  
         objection, it was so ordered.   
          
         At 5:53 p.m. Senator Zaffirini assumed the chair.   
          
         The chair laid out SB 1034 and recognized the author, Senator  
         West, to explain the bill.  The chair opened public testimony;  
         there being no witness cards, public testimony was closed.   
         Senator Zaffirini moved that SB 1034 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB 676 and recognized the author, Senator  
         West, to explain the bill.  Senator West sent up a committee  
         substitute; the chair recognized Senator West to explain the  
         difference between the committee substitute and the bill as  
         filed.  The chair opened public testimony; there being no  
         witness cards, public testimony was closed.  Senator Zaffirini  
         moved that SB 676 and the committee substitute be left pending;  
         without objection, it was so ordered.   
          
         At 5:43 p.m. Senator West resumed the chair.   
  
         The chair laid out SB 1716 and recognized the author, Senator  
         Van de Putte, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Van de Putte  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Zaffirini sent up Committee  
         Amendment 1 and Committee Amendment 2. Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that SB 1716,  
         the committee substitute, Committee Amendment 1, and Committee  
         Amendment 2 be left pending; without objection, it was so  
         ordered.   
          
         The chair laid out SB 582 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Van de Putte  
         to explain the difference between the committee substitute and  
         the bill as filed.  The chair opened public testimony; there  
         being no witness cards, public testimony was closed.  Senator  
         West moved that SB 582 and the committee substitute be left  
         pending; without objection, it was so ordered.   
          
         At 6:07 p.m. Senator Zaffirini assumed the chair.   
          
         The chair laid out SB 1701 and recognized Senator West, in the  
         absence of the author, to explain the bill.  Senator West sent  
         up a committee substitute; the chair recognized Senator West to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator West sent up Committee Amendment 1.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Zaffirini  
         moved that SB 1701, the committee substitute, and Committee  
         Amendment 1 be left pending; without objection, it was so  
         ordered.    
          
         At 6:11 p.m. Senator West resumed the chair.   
          
         The chair laid out SB 30 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  The chair opened public testimony; there being  
         no witness cards, public testimony was closed.  Senator West  
         moved that SB 30 and the committee substitute be left pending;  
         without objection, it was so ordered.   
          
         The chair laid out SB 448 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
  
         Senator West moved that SB 448 and the committee substitute be  
         left pending; without objection, it was so ordered.   
          
         At 6:16 p.m. Senator Zaffirini assumed the chair.   
          
         The chair laid out SB 1228 and recognized Senator West, in the  
         absence of the author, to explain the bill.  Senator West sent  
         up Committee Amendment 1 and Committee Amendment 2.  The chair  
         opened public testimony; there being no witness cards, public  
         testimony was closed.  Senator Zaffirini moved that SB 1228,  
         Committee Amendment 1, Committee Amendment 2 be left pending;  
         without objection, it was so ordered.   
          
         At 6:22 p.m. Senator West resumed the chair.   
          
         There being no further business, at 6:23 p.m. Senator West moved  
         that the Committee stand recessed subject to the call of the  
         chair.  Without objection, it was so ordered.
