         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Higher Education was held on Tuesday, May 3, 2005, in the Senate  
         Chamber at Austin, Texas.

         The posting rule, Senate Rule 11.18, was suspended to hear the  
         following bill(s): HB 479, SB 817, SB 1452, SB 1809, SB 1883.  
          
         The chair called the meeting to order at 3:39 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Averitt moved adoption of the minutes from the previous  
         hearings held on April 25, 2005, and April 26, 2005; without  
         objection, it was so ordered.   
          
         The chair laid out HB 479.  Senator Averitt moved that HB 479 be  
         reported favorably to the Full Committee with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 6 ayes, 0 nay, 0 present not voting, and 0  
         absent.    
          
         Senator Averitt assumed the chair.   
          
         The chair laid out SB 817 and recognized the author, Senator  
         West, to explain the bill.  Senator West moved adoption of the  
         committee substitute sent up on May 2, 2005; without objection,  
         it was so ordered.  Senator West moved adoption of Committee  
         Amendment 1 sent up on May 2, 2005; without objection, it was so  
         ordered.  Senator Averitt requested unanimous consent to  
         incorporate amendments into the committee substitute; without  
         objection, it was so ordered.  Senator Averitt then moved that  
  
         the new committee substitute be adopted; without objection, it  
         was so ordered.  Senator West moved that SB 817 do not pass but  
         that CSSB 817 be reported back to the Full Committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 0 absent.   
          
         Senator West resumed the chair.   
          
         The chair laid out SB 1452.  Senator Janek moved adoption of the  
         committee substitute sent up on May 2, 2005; without objection,  
         it was so ordered.  Senator Janek moved that SB 1452 do not pass  
         but that CSSB 1452 be reported back to the Full Committee with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 0 absent.    
          
         The chair laid out SB 1809.  Senator Staples moved adoption of  
         the committee substitute sent up on May 2, 2005; without  
         objection, it was so ordered.  Senator Staples moved that SB  
         1809 do not pass but that CSSB 1809 be reported back to the Full  
         Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 0 absent.   
          
         The chair laid out SB 1883.  Senator Staples moved that SB 1883  
         be reported favorably to the Full Committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 0 absent.   
          
         Senator Zaffirini requested unanimous consent to be shown as  
         voting "Aye" on the following bills: SB 817, SB 1452, SB 1809,  
         and SB 1883. Without objection, it was so ordered. 
          
         There being no further business, at 3:46 p.m. Senator West moved  
         that the Committee stand recessed subject to the call of the  
         chair.  Without objection, it was so ordered.
