         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Higher Education was held on Monday, May 9, 2005, in the Betty  
         King Committee Hearing Room, 2E.20, at Austin, Texas.

         The chair called the meeting to order at 7:58 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Senator Averitt moved adoption of the minutes from the previous  
         hearings held on May 2, 2005, and May 3, 2005; without  
         objection, it was so ordered.   
          
         The chair laid out HB 598 and recognized the Senate sponsor,  
         Senator Staples, to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator Staples moved that HB 598 be reported favorably  
         to the Full Committee with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 5  
         ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out HB 1274 and recognized the Senate sponsor,  
         Senator Estes, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that HB 1274  
         be left pending; without objection, it was so ordered.   
          
         The chair laid out HB 2108 and recognized the Senate sponsor,  
         Senator Eltife, to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator Staples moved that HB 2108 be reported  
         favorably to the Full Committee with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
  
         of 5 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out HB 2272 and recognized the Senate sponsor,  
         Senator Estes, to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator Averitt moved that HB 2272 be reported  
         favorably to the Full Committee with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 5 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out HB 258 and recognized the Senate sponsor,  
         Senator Hinojosa, to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator Staples moved that HB 258 be reported favorably  
         to the Full Committee with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 5  
         ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out HB 993 and recognized the Senate sponsor,  
         Senator Hinojosa, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Williams moved that HB  
         993 be reported favorably to the Full Committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out HB 1170 and recognized the Senate sponsor,  
         Senator Shapleigh, to explain the bill.  Senator Averitt sent up  
         a committee substitute; the chair recognized Senator Shapleigh  
         to explain the difference between the committee substitute and  
         the bill as filed.  The chair opened public testimony; there  
         being no witness cards, public testimony was closed.  Senator  
         Williams moved adoption of the committee substitute; without  
         objection, it was so ordered.  Senator Williams moved that HB  
         1170 do not pass but that CSHB 1170 be reported back to the Full  
         Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         The chair laid out HB 1331 and recognized the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Zaffirini moved that HB  
         1331 be reported favorably to the Full Committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         At 8:27 p.m. Senator Averitt assumed the chair.   
          
         Senator Williams asked unanimous consent to be shown as voting  
         "Aye" on HB 598; without objection, the motion was adopted. 
  
         The chair laid out HB 1630 and recognized the Senate sponsor,  
         Senator West, to explain the bill.  Senator West sent up a  
         committee substitute; the chair recognized Senator West to  
         explain the difference between the committee substitute and the  
         bill as filed.  The chair opened public testimony; there being  
         no witness cards, public testimony was closed.  Senator Williams  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator West moved that HB 1630 do not pass  
         but that CSHB 1630 be reported back to the Full Committee with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out HB 1697 and recognized the Senate sponsor,  
         Senator West, to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator Williams moved that HB 1697 be reported  
         favorably to the Full Committee with the recommendation that it  
         do pass and be printed.  The motion carried with a record vote  
         of 5 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         At 8:32 p.m. Senator West resumed the chair.   
          
         There being no further business, at 8:32 p.m. Senator West moved  
         that the Committee stand recessed subject to the call of the  
         chair.  Without objection, it was so ordered.
