Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Higher Education was held on Monday, May 16, 2005, in the Betty
King Committee Hearing Room, 2E.20, at Austin, Texas.

The posting rule, Senate Rule 11.18, was suspended to hear the

The chair called the meeting to order at 2:01 p.m. The
following business was transacted:
The chair laid out HB 495 and recognized the Senate sponsor,
Senator Fraser, to explain the bill. Senator West sent up a
committee substitute; the chair recognized Senator Fraser to
explain the difference between the committee substitute and the
bill as filed. The chair opened public testimony; there being
no witness cards, public testimony was closed. Senator West
moved that HB 495 be left pending to await a quorum; without
objection, it was so ordered.
The chair laid out HB 2041 and recognized the Senate sponsor,
Senator Duncan, to explain the bill. The chair opened public

Senator Averitt moved adoption of the committee substitute for
HB 495; without objection, it was so ordered. Senator Averitt
moved that HB 495 do not pass but that CSHB 495 be reported back
to the Full Committee with the recommendation that it do pass
and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 2 absent.

Full Committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0

Senator Averitt moved that HB 1215 be reported favorably to the
Full Committee with the recommendation that it do pass and be

Senator Janek moved that HB 1409 be reported favorably to the
Full Committee with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0

Senator Averitt moved adoption of the committee substitute for
SB 934; without objection, it was so ordered. Senator Averitt
moved that SB 934 do not pass but that CSSB 934 be reported back
to the Full Committee with the recommendation that it do pass
and be printed. The motion carried with a record vote of 4
ayes, 0 nay, 0 present not voting, and 2 absent.
The chair laid out HB 1274. Senator West moved to withdraw
Committee Amendment 1; without objection, it was so ordered.
Senator Janek sent up Committee Amendment 2 and moved adoption;
without objection, it was so ordered. Senator Janek moved that
HB 1274 be reported favorably to the Full Committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 2 absent.
There being no further business, at 3:39 p.m. Senator West moved
that the Committee stand recessed subject to the call of the
