         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Higher Education was held on Monday, May 16, 2005, in the Betty  
         King Committee Hearing Room, 2E.20, at Austin, Texas.

         The posting rule, Senate Rule 11.18, was suspended to hear the  
         following bill(s): HB 2041. 
          
         The chair called the meeting to order at 2:01 p.m.  The  
         following business was transacted:   
          
         The chair laid out HB 495 and recognized the Senate sponsor,  
         Senator Fraser, to explain the bill.  Senator West sent up a  
         committee substitute; the chair recognized Senator Fraser to  
         explain the difference between the committee substitute and the  
         bill as filed.  The chair opened public testimony; there being  
         no witness cards, public testimony was closed.  Senator West  
         moved that HB 495 be left pending to await a quorum; without  
         objection, it was so ordered.   
          
         The chair laid out HB 2041 and recognized the Senate sponsor,  
         Senator Duncan, to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator West moved that HB 2041 be left pending;  
         without objection, it was so ordered.   
          
         The chair laid out HB 2441 and recognized the Senate sponsor,  
         Senator Van de Putte, to explain the bill.  The chair opened  
         public testimony; there being no witness cards, public testimony  
         was closed.  Senator West moved that HB 2441 be left pending to  
  
         await a quorum; without objection, it was so ordered.   
          
         The chair laid out HB 1063 and recognized Senator Van de Putte,  
         in the absence of the Senate sponsor, to explain the bill.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator West  
         moved that HB 1063 be left pending to await a quorum; without  
         objection, it was so ordered.   
          
         The chair laid out HB 1409 and recognized the Senate sponsor,  
         Senator Ellis to explain the bill.  The chair opened public  
         testimony; there being no witness cards, public testimony was  
         closed.  Senator West moved that HB 1409 be left pending to  
         await a quorum; without objection, it was so ordered.   
          
         At 2:20 p.m. Senator West moved that the committee stand

         At 2:45 p.m. the committee reconvened.   
          
         At 2:45 p.m. Senator Zaffirini assumed the chair.

         The chair laid out HB 2333 and recognized the Senate sponsor,  
         Senator West, to explain the bill.  The chair opened public

         At 2:47 p.m. Senator West resumed the chair.

         Wentworth, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Wentworth to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator West moved that SB 934 be left pending to await a  
         quorum; without objection, it was so ordered.   
          
         The chair laid out HB 1274 and recognized the Senate sponsor,  
         Senator Estes, to explain the bill.  Senator Zaffirini sent up  
         Committee Amendment 1.  Witnesses testifying and registering on  
         the bill are shown on the attached list.  The chair moved that  
         the public testimony be closed; without objection, it was so  
         ordered.  Senator West moved that HB 1274 be left pending to

         The chair laid out HB 868 and recognized Senator Zaffirini, in  
         the absence of the Senate sponsor, to explain the bill.  The

         left pending to await a quorum; without objection, it was so

         The chair laid out HB 64 and recognized the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Senator West sent up

         The chair laid out HB 1737 and recognized the Senate sponsor,  
         Senator Zaffirini, to explain the bill.  Senator Zaffirini sent

         await a quorum; without objection, it was so ordered.   
          
         The chair laid out HB 381 and recognized the Senate sponsor,  
         Senator Armbrister, to explain the bill.  Witnesses testifying

         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator West moved that HB 381 be  
         left pending to await a quorum; without objection, it was so

         Senator Armbrister, to explain the bill.  Witnesses testifying

         At 3:14 p.m. Senator West moved that the committee stand

         The chair laid out HB 64. Senator Zaffirini moved adoption of  
         Committee Amendment 1; without objection, it was so ordered.   
         Senator Zaffirini moved that HB 64, as amended, be reported back  
         to the Full Committee  The motion carried with a record vote of  
         4 ayes, 0 nay, 0 present not voting, and 2 absent.   
          
         Senator Zaffirini moved that HB 381 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         Senator Averitt moved adoption of the committee substitute for  
         HB 495; without objection, it was so ordered.  Senator Averitt  
         moved that HB 495 do not pass but that CSHB 495 be reported back  
         to the Full Committee with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 4  
         ayes, 0 nay, 0 present not voting, and 2 absent.   
          
         Senator Averitt moved that HB 868 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         At 3:32 p.m. Senator Averitt assumed the chair.   
          
         Senator West moved that HB 994 be reported favorably to the Full  
         Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         At 3:32 p.m. Senator West resumed the chair.   
          
         Senator Zaffirini moved that HB 1063 be reported favorably to  
         the Full Committee with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         Senator Averitt moved that HB 1215 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
                                                 
         Senator Janek moved that HB 1409 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         The chair laid out HB 1737.  Senator Zaffirini moved adoption of  
         Committee Amendment 1; without objection, it was so ordered.    
         Senator Zaffirini moved that HB 1737, as amended, be reported  
         back to the Full Committee with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 4  
         ayes, 0 nay, 0 present not voting, and 2 absent.   
          
         At 3:34 p.m. Senator Averitt assumed the chair.   
          
         Senator West moved that HB 2333 be reported favorably to the  
         Full Committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         At 3:34 p.m. Senator West resumed the chair.   
          
         Senator Zaffirini moved that HB 2441 be reported favorably to  
         the Full Committee with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         Senator Averitt moved adoption of the committee substitute for  
         SB 934; without objection, it was so ordered.  Senator Averitt  
         moved that SB 934 do not pass but that CSSB 934 be reported back  
         to the Full Committee with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 4  
         ayes, 0 nay, 0 present not voting, and 2 absent.   
          
         The chair laid out HB 1274. Senator West moved to withdraw  
         Committee Amendment 1; without objection, it was so ordered.  
         Senator Janek sent up Committee Amendment 2 and moved adoption;  
         without objection, it was so ordered.  Senator Janek moved that  
         HB 1274 be reported favorably to the Full Committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 2 absent. 
          
         There being no further business, at 3:39 p.m. Senator West moved  
         that the Committee stand recessed subject to the call of the  
         chair.  Without objection, it was so ordered.
