Witnesses providing testimony are shown on the attached list. The chair recognized Senator Whitmire to lay out the workgroup recommendations for Article V. At 8:55 a.m. Senator Ogden moved that the Committee stand recessed for 15 minutes; without objection, it was so ordered. The Committee reconvened at 9:14 a.m. At 9:15 a.m. Senator Ogden moved that the Committee stand recessed until 9:45 a.m.; without objection, it was so ordered. The Committee reconvened at 9:47 a.m. Senator Williams moved to leave pending the rider relating to the Texas Department of Criminal Justice, Contracted Temporary Capacity of the Article V workgroup recommendations. Without objection, it was so ordered. Senator Duncan moved that the rider relating to the Commission on Law Enforcement Officer Standards and Education, Limitation on Employment of the Article V workgroup recommendations be adopted in conjunction with the Article V workgroup recommendations. Without objection, it was so ordered. Senator Barrientos moved to pend Items 2 and 3 regarding the Adjutant General's Department, and Items 2 and 3 regarding the Military Facilities Commission. Without objection, it was so ordered. Senator Whitmire moved to adopt the amended workgroup recommendations for Article V, with the exception of pending items. Senator Staples seconded the motion. There was a roll call vote. The motion carried with a record vote of 15 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Nelson and Senator Shapiro requested unanimous consent to be shown voting aye on the workgroup recommendations for Article V; without objection, it was so ordered. The chair recognized Senator Duncan to lay out the workgroup recommendations for Article III relating to public education. Senator Duncan moved to adopt the workgroup recommendations for Article III relating to public education, with the exception of pending items. There was a roll call vote. The motion carried with a record vote of 9 ayes, 0 nays, 2 present not voting, and 4 absent. Senator West requested unanimous consent to be shown voting aye on the workgroup recommendations for Article III relating to public education; without objection, it was so ordered. Senator Ogden moved that SB 1 be left pending; without objection, it was so ordered. There being no further business, at 10:42 a.m. Senator Ogden moved that the Committee stand recessed until 45 minutes after adjournment of the Senate the following day, March 2, 2005.
