Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Finance was
held on Thursday, April 21, 2005, in the Capitol Extension, Room
E1.036, at Austin, Texas.

The chair called the meeting to order at 1:38 p.m. The
following business was transacted:
The posting rule, Senate Rule 11.18, was suspended to hear the
following bill(s): SB 849 by Brimer, and SJR 23 by Brimer.
The chair laid out SB 478 relating to the authority of certain
counties to impose a local tax on the sale of gasoline and to
the use of the tax revenue by a regional mobility authority, and
recognized the author, Senator Barrientos, to explain the bill.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered. Senator Ogden
moved that SB 478 be left pending; without objection, it was so
ordered.
The chair laid out SJR 15 proposing a constitutional amendment
authorizing a county to impose a local tax on the sale of
gasoline and to transfer the revenue from the tax to another
political subdivision of this state and recognized the author,
Senator Barrientos, to explain the bill. Witnesses testifying
and registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Ogden moved that SJR 15
be left pending; without objection, it was so ordered.
The chair laid out SB 849 relating to the authority of a
regional mobility authority to impose a local tax on the sale of
gasoline and diesel fuel, and recognized the author, Senator
Brimer, to explain the bill. Senator Ogden moved that SB 849 be
left pending; without objection, it was so ordered.
The chair laid out SJR 23 proposing a constitutional amendment
limiting the constitutional dedication of revenue from a tax on
motor fuels to taxes imposed by this state, and recognized the
author, Senator Brimer, to explain the bill. Senator Ogden
moved that SJR 23 be left pending; without objection, it was so
ordered.
The chair laid out SB 960 relating to hospital and clinic fees
collected by certain public medical schools, and recognized the
author, Senator Shapiro, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Ogden moved that
SB 960 be left pending; without objection, it was so ordered.
At 2:30 p.m. Senator Zaffirini assumed the chair.
The chair laid out SB 1617 relating to the powers, duties, and
functions of the Legislative Budget Board, and recognized the
author, Senator Ogden, to explain the bill. Senator Ogden sent
up a committee substitute; the chair recognized Senator Ogden to
explain the difference between the committee substitute and the
bill as filed. Witnesses testifying and registering on the bill
are shown on the attached list. Senator Zaffirini moved that SB
1617 be left pending to await a quorum; without objection, it
was so ordered.
At 2:34 p.m. Senator Ogden resumed the chair.
At 2:35 p.m. Senator Ogden moved that the Committee stand
recessed until 2:45 p.m.; without objection, it was so ordered.
The Committee reconvened at 2:47 p.m.
The roll was called, a quorum being present.
The chair laid out SB 1693 relating to collateral for deposits
of public school funds, which had been left pending at a
previous hearing, and recognized the author, Senator Duncan to
explain the bill. Senator Duncan moved that SB 1693 be reported
favorably to the Senate with the recommendation that it do pass
and be printed. The motion carried with a record vote of 12
ayes, 0 nay, 0 present not voting, and 3 absent. Senator
Shapleigh and Senator Williams requested unanimous consent to be
shown voting aye; without objection, it was so ordered. Senator
Duncan moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so
ordered.
The chair laid out HB 1489 relating to the purposes for which
money in the compensation to victims of crime fund may be used,
which had been left pending at a previous hearing, and
recognized Senator Janek, in the absence of the Senate sponsor,
to explain the bill. Senator Williams moved that HB 1489 be
reported favorably to the Senate with the recommendation that it
do pass and be printed. The motion carried with a record vote
of 12 ayes, 0 nay, 0 present not voting, and 3 absent. Senator
Williams moved that the bill be recommended for placement on the
Local & Uncontested Calendar; without objection, it was so
ordered.
At 2:54 p.m. Senator Zaffirini assumed the chair.
The chair laid out SB 1617, which had been left pending earlier
in the hearing, and recognized the author, Senator Ogden.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered. Senator Ogden
moved adoption of the committee substitute sent up earlier in
the hearing; without objection, it was so ordered. Senator
Ogden moved that SB 1617 do not pass but that CSSB 1617 be
reported back to the Senate with the recommendation that it do
pass and be printed. The motion carried with a record vote of
11 ayes, 0 nay, 1 present not voting, and 3 absent.
At 3:05 p.m. Senator Ogden resumed the chair.
There being no further business, at 3:06 p.m. Senator Ogden
moved that the Committee stand recessed subject to the call of
the chair. Without objection, it was so ordered.
