         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Government  
         Organization was held on Monday, April 25, 2005, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 3:29 p.m.  The  
         following business was transacted:   
          
         At 3:29 p.m. Senator Nelson assumed the chair.   
          
         The chair laid out SB 1201 and recognized the author, Senator  
         Ellis, to explain the bill.  Senator Ellis sent up a committee  
         substitute; the chair recognized Senator Ellis to explain the  
         difference between the committee substitute and the bill as  
         filed.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
          
         At 3:48 p.m. Senator Ellis resumed the chair.   
          
         The chair laid out HB 22 and recognized staff, in the absence of  
         the Senate sponsor, to explain the bill.   
          
         The chair moved that the roll be called, a quorum was  
         established.  
         The following members arrived after the roll was called: Senator  
         Whitmire and Senator Jackson. 
          
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Eltife  
         moved that HB 22 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 2 absent.  Senator Eltife moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB 410 and recognized Senator Nelson, in the  
         absence of the author, to explain the bill.  Senator Nelson sent  
         up a committee substitute; the chair recognized Senator Nelson  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Nelson moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Senator Ellis sent up Committee Amendment 1 and explained it.   
         Senator Ellis withdrew Committee Amendment 1.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered Senator Whitmire moved that  
         SB 410 do not pass but that CSSB 410 be reported back to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 6 ayes, 0 nay, 0  
         present not voting, and 1 absent.   
          
         At 3:58 p.m. Senator Eltife assumed the chair.   
          
         The chair called up SB 1201. Senator Nelson moved adoption of  
         the committee substitute which was previously explained; without  
         objection, it was so ordered.  Senator Nelson sent up Committee  
         Amendment 1 and moved adoption; without objection, the amendment  
         was adopted.  Senator Nelson requested unanimous consent to  
         incorporate the amendment into the committee substitute; without  
         objection, it was so ordered.  Senator Nelson then moved that  
         the new committee substitute be adopted; without objection, it  
         was so ordered.  Senator Ellis moved that SB 1201 do not pass  
         but that CSSB 1201 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Ellis moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out SB 1644 and recognized Senator Nelson, in the  
         absence of the author, to explain the bill.  Senator Nelson sent  
         up a committee substitute.  Senator Nelson moved adoption of the  
         committee substitute; without objection, it was so ordered. The  
         chair recognized Senator Shapleigh to explain the difference  
         between the committee substitute and the bill as filed.     
         Witnesses testifying and registering on the bill are shown on  
  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Whitmire  
         moved that SB 1644 do not pass but that CSSB 1644 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 6 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Nelson moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         Senator Jackson moved that he be shown voting for HB 22, CSSB  
         410, and CSSB 1201; without objection, it was so ordered.  
          
         The chair laid out HB 1025 and recognized the Senate sponsor,  
         Senator Shapleigh, to explain the bill.  Senator Whitmire sent  
         up Committee Amendment 1 and explained the amendment. Senator  
         Whitmire withdrew Committee Amendment 1. Senator Gallegos, Jr.  
         sent up Committee Amendment 2 and explained the amendment.   
         Senator Gallegos, Jr. withdrew the Committee Amendment 2.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Eltife  
         moved that HB 1025 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 6 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out SB 1645 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.   
          
         Senator Eltife moved that he be shown voting aye for SB 1644;  
         without objection, it was so ordered.  
          
         Senator Eltife moved that SB 1645 be reported favorably to the  
         Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 6 ayes, 0 nay, 0  
         present not voting, and 1 absent.  Senator Eltife moved that the  
         bill be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         Senator Gallegos, Jr. moved that he be shown voting aye for SB  
         1645; without objection, it was so ordered. 
          
         There being no further business, at 4:27 p.m. Senator Ellis  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
