         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on State Affairs  
         was held on Monday, April 25, 2005, in the Senate Chamber at  
         Austin, Texas.

         Senator Tommy Williams, the acting chair, called the meeting to  
         order at 3:56 p.m.  There being a quorum present, the following  
         business was transacted:   
          
         The chair laid out SB 70 and recognized the author, Senator  
         Shapleigh, to explain the bill.  Senator Williams sent up a  
         committee substitute; the chair recognized Senator Shapleigh to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.  The  
         bill was left pending before the committee.   
          
         The chair laid out SB 1513 and recognized the author, Senator  
         Averitt, to explain the bill.  Senator Williams sent up a  
         committee substitute; the chair recognized Senator Averitt to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Williams moved that SB 1513 be left pending to await a  
         quorum; without objection, it was so ordered.  Upon arrival of a  
         quorum, Senator Fraser moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Fraser moved that SB 1513 do not pass but that CSSB 1513 be  
  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 8  
         ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Fraser  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out SB 1531 and recognized the author, Senator  
         Averitt, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  The bill was left pending before  
         the committee. 
          
         The chair laid out SB 1243 and recognized the author, Senator  
         Carona, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  The bill was left pending before  
         the committee.   
          
         Senator Armbrister assumed the chair.   
          
         The chair laid out SB 1355 and recognized Senator Williams, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  The bill was left pending  
         before the committee. 
          
         Senator Williams resumed the chair.   
          
         The chair laid out SB 375 and recognized Senator Armbrister, in  
         the absence of the author, to explain the bill.  Senator  
         Armbrister sent up a committee substitute; the chair recognized  
         Senator Armbrister to explain the difference between the  
         committee substitute and the bill as filed.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  The bill was left pending  
         before the committee. 
          
         The chair laid out SB 653 and recognized Senator Lucio, Jr., in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  The bill was left pending  
         before the committee. 
          
         The chair laid out pending business SB 1176.  The committee had  
         a committee substitute and two committee amendments on the table  
         before it, all of which had been offered at a previous hearing.   
         Senator Armbrister moved adoption of Committee Amendment 1;  
         without objection, the amendment was adopted.  Senator  
         Armbrister moved adoption of Committee Amendment 2; without  
         objection, the amendment was adopted.  Senator Armbrister  
  
         requested unanimous consent to incorporate amendments into the  
         committee substitute; without objection, it was so ordered.   
         Senator Armbrister then moved that the new committee substitute  
         be adopted; without objection, it was so ordered.  Senator  
         Armbrister moved that SB 1176 do not pass but that CSSB 1176 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 8  
         ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out pending business SB 1648.  Senator Fraser had  
         offered Committee Amendment 1 at a previous hearing and now  
         moved adoption; without objection, the amendment was adopted.   
         Senator Fraser requested unanimous consent to incorporate  
         amendments into the committee substitute; without objection, it  
         was so ordered.  Senator Fraser then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Fraser moved that SB 1648 do not pass but that  
         CSSB 1648 be reported back to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 8 ayes, 0 nay, 0 present not voting, and 1  
         absent.  Senator Fraser moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         There being no further business, Senator Williams moved that the  
         Committee stand recessed subject to the call of the chair.   
         Without objection, it was so ordered.
