         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on State Affairs  
         was held on Wednesday, July 6, 2005, in the Senate Chamber at  
         Austin, Texas.

         The chair called the meeting to order at 11:12 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out pending bills SB 62 and SJR 9 by Janek, and  
         SJR 10 by Deuell.  Senator Madla sent up a committee substitute  
         for SB 62.  Senator Janek was recognized to explain the  
         differences between the substitute and the bill as filed.   
         Senator Madla moved the adoption of the committee substitute;  
         without objection, the substitute was adopted.   
          
         The chair moved to reopen testimony on SB 62, SJR 9 and SJR 10.   
         Without objection, public testimony was reopened.  Witnesses  
         registering and testifying on the bills are shown on the  
         attached list.  The chair moved that public testimony be closed,  
         without objection, public testimony was closed. Senator Madla  
         moved that SB 62 do not pass but that CSSB 62 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 7 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         There being no further business, Senator Duncan moved that the  
         Committee stand recessed subject to the call of the chair.   
         Without objection, it was so ordered.
