         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Natural  
         Resources was held on Tuesday, March 8, 2005, in the Capitol  
         Extension, Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 2:50 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out SB 699 and recognized the author, Senator  
         Hinojosa, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Armbrister moved that SB  
         699 be left pending; without objection, it was so ordered.   
          
         The chair laid out SB 484 and recognized the author, Senator  
         Barrientos, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Armbrister moved that SB  
         484 be left pending; without objection, it was so ordered.   
          
         Senator Jackson assumed the chair.   
          
         The chair laid out SB 575 and recognized the author, Senator  
         Armbrister, to explain the bill.  Witnesses testifying and  
  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Armbrister moved that SB  
         575 be left pending; without objection, it was so ordered.   
          
         The chair laid out SB 519 and recognized the author, Senator  
         Armbrister, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Armbrister sent up  
         Committee Amendment 1 .  Senator Armbrister moved that SB 519 be  
         left pending; without objection, it was so ordered.   
          
         Senator Armbrister resumed the chair.   
          
         The subcommittee report on SB 161 was laid out by Senator  
         Jackson.  Senator Jackson was recognized to explain the  
         subcommittee report on SB 161.  Senator Jackson moved SB 161 do  
         not pass but the CSSB 161 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 9 ayes and 0 nay, 0 present not  
         voting, and 2 absent.  
          
         Senator Duncan requested unanimous consent to be shown voting  
         aye on SB 161.  Their being no objection, it was so ordered.  
          
         Senator Fraser requested unanimous consent to be shown voting  
         aye on SB 161.  Their being no objection, it was so ordered.  
          
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The subcommittee report on SB 370 was laid out by Senator  
         Jackson.  Senator Jackson was recognized to explain the  
         subcommittee report on SB 370.  Senator Jackson moved that SB  
         370 be reported favorably to the full Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 9 ayes and 0 nay, 0 present not  
         voting, and 2 absent.  
          
         Senator Barrientos requested unanimous consent to be shown  
         voting aye on SB 370.  There being no objection, the motion  
         carried.  
          
         Senator Duncan requested unanimous consent to be shown voting  
         aye on SB 370.  There being no objection, the motion carried.  
          
         Senator Fraser requested unanimous consent to be shown voting  
         aye on SB 370.  There being no objection, the motion carried.  
          
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.      
          
         The subcommittee report on SB 372 was laid out by Senator  
         Jackson.  Senator Jackson was recognized to explain the  
         subcommittee report on SB 372.  Senator Jackson moved SB 372 be  
         reported back to the full Senate with recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 9  
         ayes, 0 nay, 0 present not voting, and 2 absent.   
          
         Senator Fraser requested unanimous consent to be shown voting  
         aye on SB 372.  There being no objection, the motion carried.   
          
         Senator Madla moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The subcommittee report on SB 373 was laid out by Senator  
         Jackson.  Senator Jackson was recognized to explain the  
         subcommittee report on SB 373.  Senator Jackson sent up a  
         committee substitute; the chair recognized Senator Jackson to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Jackson moved adoption of the committee  
         substitute; without objection, it was so ordered.Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Jackson moved  
         that SB 373 do not pass but that CSSB 373 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 9 ayes, 0  
         nay, 0 present not voting, and 2 absent.   
          
         Senator Fraser requested unanimous consent to be shown voting  
         aye on CSSB373.  There being no objection, the motion carried.   
          
         Senator Seliger moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered. 
          
         The subcommittee report on SB 471 was laid out by Senator  
         Jackson.  Senator Jackson was recognized to explain the  
         subcommittee report on SB 471.  Senator Jackson moved that SB  
         471 be reported favorably to the Senate with the recommendation  
         that it do pass and be printed.  The motion carried with a  
         record vote of 9 ayes, 0 nay,  present not voting, and 2 absent.   
          
         Senator Fraser requested unanimous consent to be shown voting  
         aye on SB 471.  There being no objection, the motion carried.   
          
         Senator Seliger moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The subcommittee report on SB 487 was laid out by Senator  
         Jackson.  Senator Jackson was recognized to explain the  
         subcommittee report on SB 487.  Senator Jackson moved that SB  
         487 do not pass but that CSSB 487 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
  
         motion carried with a record vote of 9 ayes, 0 nay, 0 present  
         not voting, and 2 absent.   
          
         Senator Fraser requested unanimous consent to be shown voting  
         aye on CSSB 487.  There being no objection, the motion carried.   
          
         Senator Duncan moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         There being no further business, at 6:40 p.m. Senator Armbrister  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
