Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Standing Senate Subcommittee on
Agriculture and Coastal Resources was held on Wednesday, March
30, 2005, in the Capitol Extension, Room E1.036, at Austin,
Texas.

The chair called the meeting to order at 3:16 p.m. There being
a quorum present, the following business was transacted:
Senator Jackson moved adoption of the minutes from the previous
hearing held on March 8, 2005; without objection, it was so
ordered.
The chair laid out SB 740 and recognized the author, Senator
Janek, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Jackson moved that SB 740
be left pending; without objection, it was so ordered.
The chair explained to the committee that SB 1040 would not be
heard today.
The chair laid out SB 1091 and recognized Senator Estes, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Estes moved that
SB 1091 be reported favorably to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 3 ayes, 0 nay, 0 present not
voting, and 0 absent.
The chair laid out SB 517 and recognized the author, Senator
Armbrister, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Estes moved that SB 517
be reported favorably to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 3 ayes, 0 nay, 0 present not
voting, and 0 absent.
The chair laid out SB 1428 and recognized the author, Senator
Duncan, to explain the bill. Senator Estes sent up Committee
Amendment 1 and moved adoption; without objection, the amendment
was adopted. Senator Estes sent up a committee substitute; the
chair recognized Senator Duncan to explain the difference
between the committee substitute and the bill as filed. Senator
Estes moved adoption of the committee substitute; without
objection, it was so ordered. Senator Estes requested unanimous
consent to incorporate amendments into the committee substitute;
without objection, it was so ordered. Senator Estes then moved
that the new committee substitute be adopted; without objection,
it was so ordered. Witnesses testifying and registering on the
bill are shown on the attached list. The chair moved that the
public testimony be closed; without objection, it was so
ordered. Senator Estes moved that SB 1428 do not pass but that
CSSB 1428 be reported back to the full committee with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 3 ayes, 0 nay, 0 present not
voting, and 0 absent.
At 4:25 p.m. Senator Estes assumed the chair.

Jackson, to explain the bill. Witnesses testifying and

objection, it was so ordered. Senator Jackson moved that SB 592
be reported favorably to the full committee with the
recommendation that it do pass and be printed. The motion

There being no further business, at 5:31 p.m. Senator Jackson
moved that the Committee stand recessed subject to the call of
