         Pursuant to suspension of Senate Rules 11.10 and 11.18, a public  
         hearing of the Senate Committee on Transportation and Homeland  
         Security was held on Thursday, April 14, 2005, in the Senate  
         Chamber at Austin, Texas.

         The chair called the meeting to order at 1:20 p.m.  The clerk  
         called the roll, there being a quorum present, the following  
         business was transacted:   
          
         Senate posting rules 11.10 and 11.18, were suspended to hear the  
         following pending bill(s):  
          
         The chair laid out, as pending business, SB 642 and explained  
         the bill. The bill was left pending temporarily. 
          
         The chair laid out, as pending business, SB 737.  Senator Brimer  
         moved that SB 737 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Brimer moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out, as pending business, CSSB 1336.  The  
         committee substitute was previously adopted at the committees  
         April 13, 2005 hearing. Senator Lindsay moved that SB 1336 do  
         not pass but that CSSB 1336 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 8 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Brimer moved that the bill be  
  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         At 1:23 p.m. Senator Brimer assumed the chair.   
          
         The chair laid out, as pending business, SB 1670. Senator  
         Staples moved that SB 1670 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 8 ayes, 0 nay, 0 present  
         not voting, and 1 absent. Senator Barrientos moved that SB 1670  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         At 1:26 p.m. Senator Staples resumed the chair.  
          
         The chair laid out again, as pending business, SB 642 and asked  
         for a motion.  No motion was made; the bill was left pending. 
          
         The chair laid out, as pending business, SB 292 and asked for a  
         motion.  No motion was made; the bill was left pending.  
          
         Senator Shapiro requested unanimous consent to be shown voting  
         aye on SB 737;  the vote is reflected in the bills total. 
          
         Senator Shapleigh wished to be shown voting aye on SB 737, SB  
         1336, SB 1670 the votes are reflected in each bills total.  
          
         There being no further business, at 1:30 p.m. Senator Staples  
         moved that the committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
