Amend CSHB 447 by adding a new Section to read as follows:                   
	SECTION __.  Section 11.168, Education Code, is amended by 
adding Subsection (b) to read as follows:
	(b)  This section does not prohibit the board of trustees of 
a school district from entering into an agreement with a 
non-governmental entity for the design, construction or renovation 
of improvements to real property not owned or leased by the 
district, if such improvements provide a benefit to real property 
owned or leased by the district.  Benefits to real property owned or 
leased by the district include, but are not limited to, the design, 
construction or renovation of highways, roads, streets, sidewalks, 
cross walks, utilities and drainage improvements which serve or 
benefit the real property owned or leased by the school district.
