Amend HB 735 (House Committee Printing) as follows:
(1) Strike Section 14 (a) of the bill (page 12, lines 7-12)
and substitute:
(a) Liability for the assessment imposed under Section
57.048, Utilities Code, expires March 31, 2007. The assessment
imposed for the calendar quarter ending March 31, 2007, is due on
the last day of April, 2007, and Section 57.048, Utilities Code, is
continued in effect for the collection of the assessment due and for
civil and criminal enforcement of the liability for that
assessment. If this Act does not take effect immediately, the
Public Utility Commission of Texas by rule shall require a
telecommunications utility or commercial mobile service provider
subject to Section 57.048, Utilities Code, to refund to the
customers amounts collected that relate to the assessment imposed
under that section after March 31, 2007. The Public Utility
Commission of Texas shall prescribe the mechanism used to make the
refunds.
(2) Strike Section 15 of the bill (page 12, lines 19-26) and
substitute:
SECTION 15. This Act takes effect immediately if this Act
receives a vote of two-thirds of all the members elected to each
house, as provided by Section 39, Article III, Texas Constitution.
If this Act does not receive the vote necessary for immediate
effect, this Act takes effect September 1, 2007.
