Amend CSHB 1038 as follows:                                                  

(1)  On page 6, between lines 8 and 9, insert the following 	appropriately numbered SECTION and renumber subsequent SECTIONS 
accordingly:
	SECTION ____.  Section 416.001, Property Code, is amended to 
read as follows:
	Sec. 416.001.  REGISTRATION REQUIRED. (a)  A person may not 
act as a builder unless the person holds a certificate of 
registration under this chapter.
	(b)  A person commits an offense if the person violates 
Subsection (a).  An offense under this section is a Class A 
misdemeanor.
	(2)  On page 21, between lines 24 and 25, insert the 
following appropriately numbered SECTION and renumber subsequent 
SECTIONS accordingly:
	SECTION ____.  The changes in law made by this Act to Section 
416.001, Property Code, apply only to an offense committed on or 
after the effective date of this Act.  An offense committed before 
the effective date of this Act is governed by the law in effect at 
the time the offense was committed, and the former law is continued 
in effect for that purpose.  For the purposes of this section, an 
offense was committed before the effective date of this Act if any 
element of the offense occurred before that date.
