Amend HB 2006 (Senate committee printing) in SECTION 2 of the bill, immediately following added Section 2206.051, Government Code (page 5, between line 26-27), by adding the following: Sec. 2206.052. LIMITATIONS ON EASEMENTS. (a) A property owner whose property is acquired through the use of eminent domain under Chapter 21, Property Code, for the purpose of creating an easement through that owner's property may construct streets or roads, including a gravel, asphalt, or concrete road, at any locations above the easement that the property owner chooses. (b) The portion of a road constructed under this section that is over the easement may not exceed 40 feet in width.
