80(R) HB 2828 - 3rd reading 1 (H)

	Amend HB 2828 as follows:                                                    
	1. On page 6, line 5 and 6, strike "An offense under 
Subsection (i) or (j) is a felony of the third degree."
	2. On page 6, line 5, after "(1)", insert the following:                       

"An offense under Subsection (i) or (j) is:                                   
		(1) a Class B misdemeanor if the person convicted under 
this Section has not previously been convicted of an offense under 
this Section,
		(2) a Class A misdemeanor if the person convicted under 
this Section has previously been convicted of one offense under 
this Section,
		(3) a State Jail Felony if the person convicted under 
this Section has previously been convicted of two offenses under 
this Section,
		(4) a Felony of the third degree if the person convicted 
under this Section has been convicted of three or more offenses 
under this Section."
