Amend CSSB 7 (Senate committee printing) as follows:                         
	(1)  Immediately before SECTION 1 of the bill (page 1, 
between lines 13 and 14), insert the following appropriately 
numbered SECTION and renumber the subsequent SECTIONS accordingly:
	SECTION ____.  Section 5.001, Education Code, is amended by 
adding Subdivision (6-a) to read as follows:
		(6-a)  "Private school" means a school that:                           
			(A)  offers a course of instruction for students 
in one or more grades from prekindergarten through grade 12; and
			(B)  is not operated by a governmental entity.                        
	(2)  In SECTION 2 of the bill, in added Section 22.902, 
Education Code (page 1, between lines 48 and 49), insert the 
following:
	(e)  This subsection applies only to a private school that 
receives an automated external defibrillator from the agency or 
receives funding from the agency to purchase or lease an automated 
external defibrillator. A private school shall adopt a policy under 
which the school makes available to school employees and volunteers 
instruction in the principles and techniques of cardiopulmonary 
resuscitation and the use of an automated external defibrillator.  
The policy must comply with the requirements prescribed by this 
section and commissioner rules adopted under this section, 
including the requirements prescribed by Subsection (c).
	(3)  In SECTION 3 of the bill, in added Section 28.0023, 
Education Code (page 1, between lines 59 and 60), insert the 
following:
	(c)  This subsection applies only to a private school that 
receives an automated external defibrillator from the agency or 
receives funding from the agency to purchase or lease an automated 
external defibrillator. A private school shall provide instruction 
to students in cardiopulmonary resuscitation and the use of an 
automated external defibrillator in a manner consistent with the 
requirements of this section and State Board of Education rules 
adopted under this section.
	(4)  In SECTION 5 of the bill, in added Section 38.017, 
Education Code (page 2, between lines 34 and 35), insert the 
following:
	(e)  This subsection applies only to a private school that 
receives an automated external defibrillator from the agency or 
receives funding from the agency to purchase or lease an automated 
external defibrillator. A private school shall:
		(1)  make available at the school at least one 
automated external defibrillator; and
		(2)  in coordination with the Texas Association of 
Private and Parochial Schools, adopt a policy concerning the 
availability of an automated external defibrillator at athletic 
competitions and practices in a manner consistent with the 
requirements prescribed by this section, including the training and 
maintenance requirements prescribed by this section.
	(5)  In SECTION 5 of the bill, in added Section 38.018, 
Education Code (page 2, lines 36 and 37), strike "Each school 
district shall develop safety procedures for a district employee or 
student" and substitute "(a)  Each school district and private 
school shall develop safety procedures for a district or school 
employee or student".
	(6)  In SECTION 5 of the bill, in added Section 38.018, 
Education Code (page 2, between lines 42 and 43), insert the 
following:
	(b)  A private school is required to develop safety 
procedures under this section only if the school receives an 
automated external defibrillator from the agency or receives 
funding from the agency to purchase or lease an automated external 
defibrillator.
	(7)  In SECTION 6 of the bill, in added Section 44.047, 
Education Code (page 2, line 46), strike "A school district that 
purchases" and substitute "(a)  A school district or private school 
that purchases".
	(8)  In SECTION 6 of the bill, in added Section 44.047, 
Education Code (page 2, between lines 50 and 51), insert the 
following:
	(b)  A private school that purchases or leases an automated 
external defibrillator is required to comply with the requirements 
of this section only if the school receives funding from the agency 
to purchase or lease the automated external defibrillator.
	(9)  In SECTION 8 of the bill, immediately following added 
Subsection (b) (page 2, between lines 62 and 63), insert the 
following:
	(b-1)  Each private school to which Section 28.0023(c), 
Education Code, as added by this Act, applies shall provide 
instruction in cardiopulmonary resuscitation and the use of an 
automated external defibrillator as required by that section 
beginning with the 2008-2009 school year.
