Amend CSSB 125 (Senate committee printing) as follows:
(1) On page 1, lines 50-54, strike proposed paragraph (1)
and substitute the following:
"(1) send 50 percent of the revenue derived from civil
or administrative penalties collected by the local authority under
this section
(A) to the comptroller for deposit to the credit
of the Regional Trauma account established under Section 782.002,
Health and Safety Code; or
(B) if a public hospital, hospital district, or a
health care district is located within the jurisdiction of the
local authority, to the comptroller for deposit to the credit of the
upper payment limit program account established under Section
542.4061; and"
(2) On page 2, between lines 25 and 26, insert the
following:
"Sec. 542.4061. UPPER PAYMENT LIMIT ACCOUNT. (a) The
designated upper payment limit account is created as a dedicated
account in the general revenue fund of the state treasury. Money in
the account may be appropriated only to the Health and Human
Services Commission or a health and human services agency, as
defined by Section 531.001, Government Code, for a purpose that
qualifies as a state expenditure for which federal matching funds
under the upper payment limit supplemental payment program are
available.
(b) The account is composed of money deposited to the credit
of the account under Section 707.016 and the earnings of the
account."
