	Amend SB 792 by adding the following SECTION to the bill, 
appropriately numbered, and renumbering existing SECTIONS 
accordingly:
	SECTION ____.  Chapter 379C, Local Government Code, is 
amended by adding Section 379C.0085 to read as follows:
	Sec. 379C.0085.  RESALE OF CERTAIN REAL PROPERTY; OFFER TO 
LAND BANK.  (a)  In this section, "department" means the Texas 
Department of Transportation.
	(b)  This section applies only to real property in a 
municipality to which this chapter applies that was acquired by the 
department for right-of-way purposes through the use of eminent 
domain, including any land acquired for toll projects or under the 
terms of a comprehensive development agreement under the 
Transportation Code.
	(c)  If all or any part of the real property ceases to be 
needed for right-of-way purposes, in connection with the unneeded 
property, the department shall comply with Sections 21.102 and 
21.103, Property Code.
	(d)  If the property owner, or the owner's heirs, successors, 
or assigns, elects not to repurchase the real property from the 
department, the department shall offer the land bank the option to 
acquire all or any part of the unneeded property, without cost or 
expense to the land bank.
