Amend Floor Amendment No. 1 to CSSB 792 in SECTION 7.01 of the 
amendment, in proposed Section 228.0111, Transportation Code (page 
17, between lines 16 and 17), by inserting:
	(e-1) If the local toll project entity and the department are 
unable to mutually agree on the terms and conditions for the 
development, construction, and operation of the toll project as 
required by Subsection (e), neither the local toll project entity 
or the department may develop the project as a toll project.
