	Amend CSSB 909 by adding the following appropriately numbered 
SECTIONS:    
	SECTION ____. Section 508.146, Government Code, is amended by 
amending Subsection (d) and adding Subsections (g) and (h) to read 
as follows:
	(d) The Texas Correctional Office on Offenders with Medical 
or Mental Impairments and the [Texas] Department of Aging and 
Disability [Human] Services shall jointly request proposals from 
public or private vendors to provide under contract services for 
inmates released on medically recommended intensive supervision. A 
request for proposals under this subsection may require that the 
services be provided in a medical care facility located in an urban 
area. [For the purposes of this subsection, "urban area" means the 
area in this state within a metropolitan statistical area, 
according to the standards of the United States Bureau of the 
Census.]
	(g) The Texas Correctional Office on Offenders with Medical 
or Mental Impairments and the Department of Aging and Disability 
Services may jointly:
		(1) with a real estate investment trust, enter into a 
lease agreement 20 or fewer years in length to finance, design, and 
build in a county contiguous to an urban area a medical facility to 
house inmates released on medically recommended intensive 
supervision under this section; and
		(2) contract with a private vendor to provide treatment 
services at a facility described by Subdivision (1).
	(h) In this section, "urban area" means the area in this state 
within a metropolitan statistical area, according to the standards 
of the United States Bureau of the Census.
	(i) for purposes of this section, the Texas Correctional 
Office on Offenders with Medical and Mental Impairments shall be 
construed to be providing technical assistance to ensure that the 
State of Texas receive credit for Medicare funding.
