Amend CSSB 966 as follows:                                                   
	(1)  In SECTION 1 of the bill, on page 3, between lines 38 and 
39, insert "Sec. 22.028.  NOT APPLICABLE TO CRIMINAL 
MATTERS.  This subchapter is not applicable to criminal 
proceedings.".
	(2)  Strike SECTION 2 of the bill in its entirety, and insert 
new SECTION 2 to read as follows:
	SECTION 2.  Chapter 24, Code of Criminal Procedure, is 
amended by adding Article 24.031 to read as follows:
	Art. 24.031.  SUBPOENA TO JOURNALIST.  If a journalist, as 
defined in Chapter 22, Civil Practices and Remedies Code, contests 
the issuance of a subpoena for any information, document or item 
gathered in preparation of dissemination by a news medium, the 
court, after notice and a hearing to the parties, may quash the 
subpoena if the court determines that the subpoena fails to request 
the production of relevant and material evidence, or if the 
subpoena was issued for the purpose of harassment.  The court may 
require testimony at the hearing, may require an in camera 
inspection of the contested information or evidence, and may 
require modification to the scope of the subpoena.
