	Amend SB 1266 by striking all below the enacting clause and 
substituting the following:
	SECTION 1.  Section 222.104, Transportation Code, is amended 
by adding Subsection (g-1) to read as follows:
	(g-1)  Notwithstanding Subsection (g), as added by Chapter 
994, Acts of the 79th Legislature, Regular Session, 2005, in any 
state fiscal year that begins on or after September 1, 2007, the 
commission may not provide for the payment of pass-through tolls 
under this section in a total amount that is less than the total 
amount of pass-through tolls paid in the preceding state fiscal 
year.  This subsection expires September 1, 2011.
	SECTION 2.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2007.
