BACKGROUND AND PURPOSE

 

Currently, Subchapter E, Chapter 232, Local Government Code, pertaining to infrastructure planning provisions in certain urban counties, is applicable to a county that, first, is subject to county regulations under Subchapter A or B of Chapter 232, Local Government Code, and, second, that satisfies any one of four other applicability requirements, including a county that has a population of 150,000 or more and is adjacent to an international border or has a population of 700,000 or more. 

 

The purpose of C.S.H.B. 117 is to amend the second applicability requirement provision found in Section 232.100(2)(A) and (B), Local Government Code, by removing language regarding a county that has a population of 150,000 or more and is adjacent to an international border or has a population of 700,000 or more, and replacing it to read in a county that has a population of 150,000 or more.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.               Amends Section 232.100, Local Government Code, as follows:

 

Removes language regarding a county that has a population of 150,000 or more and is adjacent to an international border or has a population of 700,000 or more, and replaces it to read in a county that has a population of 150,000 or more.  Renumbers subsequent provisions accordingly.

 

SECTION 2.               Effective Date.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

SECTION 1.               H.B. 117 includes counties with a population of 150,000 or more that are the location of certain main campuses of general academic teaching institutions to the group of counties delineated under the second applicability requirement that are permitted to regulate certain aspects of the subdivision of land.

 

                                    C.S.H.B. 117 removes the Original addition, deletes in part two of the second applicability requirements, and replaces them with a new provision to include a county that has a population of 150,000 or more.
