AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, Texas law requires the seller of a home to disclose certain information regarding the property's current condition, its history, its malfunctions, and other known problems with the home.  However, there is no requirement that sellers disclose information that a home was previously used for the production of methamphetamine.

 

H.B. 271 requires the seller of real property to disclose to the potential buyer whether the seller had knowledge that the premises had been used for the manufacture of methamphetamine.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 5.008(b), Property Code, to include a question regarding whether the seller was aware of previous use of the premises for the manufacture of methamphetamine within the form to which the required notice must be substantially similar.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: January 1, 2008.
