AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the fee for depositing a will varies from three to five dollars.  The inconsistency arises from the legislature raising the fee in Local Government Code, but not in the Probate Code or the Government Code.

 

As proposed, H.B. 290 conforms the fee for deposit of a will in the Probate Code and the Government Code with the five dollar fee set in the Local Government Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 71(a), Texas Probate Code,  as follows:

 

(a) Requires the county clerk, on being paid a fee of five dollars, rather than three dollars, to receive and keep the will, and to give a certificate of deposit for it.

 

SECTION 2.  Amends Section 101.081, Government Code, to make a conforming change.

 

SECTION 3.  Amends Section 101.101, Government Code, to make a conforming change.

 

SECTION 4.  Amends Section 101.121, Government Code, to make a conforming change.

 

SECTION 5.  Effective date: upon passage or September 1, 2007.
