AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
The 44th Legislature, 2nd Called Session, 1935, created the Commission of Control for Texas Centennial Celebrations (commission) to coordinate local celebrations and build monuments in tribute to Texas's 100th anniversary. The legislature also authorized the commission to condemn land "for the purpose of preserving, restoring, or marking any place of historical significance." Although the commission's activities ceased shortly after the state's centennial celebration ended in 1937, certain portions of the commission's authority remain in Texas law.
H.B. 385 repeals the portion of law authorizing the commission to condemn sites of historical significance for the state's centennial celebration that ended over 70 years ago.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to any state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Repealer: Chapter 433 (Condemnation of Historical Sites), Acts of the 44th Legislature, 2nd Called Session, 1935 (Article 3264c, V.T.C.S.).
SECTION 2. Effective date: upon passage or September 1, 2007.
