BACKGROUND AND PURPOSE
In 1935, the 44th Legislature created the Commission of Control for Texas Centennial Celebrations (commission) to coordinate local celebrations and build monuments in tribute to Texas' 100th anniversary. The Legislature also authorized the commission to condemn land "for the purpose of preserving, restoring or marking any place of historical significance." Although the commission's activities ceased shortly after the state's centennial celebration ended in 1937, certain portions of the agency's authority remain in Texas law.
House Bill 385 repeals the portion of law authorizing the Commission of Control for Texas Centennial Celebrations to condemn sites of historical significance for the state's centennial celebration that ended over 70 years ago.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
Repeals Chapter 433, Acts of the 44th Legislature, 2nd Called Session, 1935 that authorized the Commission of Control for Texas Centennial Celebrations to condemn historical sites for the state's centennial celebration.
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
