AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The 78th Legislature passed legislation that removed the burden of storm water drainage fees from colleges and universities.  This placed a hardship on small communities in funding water drainage projects where large use of storm water drains comes from colleges and universities.  Often these colleges and universities make up a significant portion of the population in smaller communities.

 

H.B. 462 authorizes a certain municipality to collect storm water drainage fees from a state agency or public institution of higher education.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 430.003, Local Government Code, as follows:

 

Sec. 430.003.  EXEMPTIONS OF STATE PROPERTY FROM INFRASTRUCTURE FEES.  (a) Creates this subsection from existing text. Provides that Subsection (b) is an exception to this subsection, which prohibits any county, municipality, or utility district from collecting from a state agency or public institution of higher education any fee charged for the development or maintenance of programs of facilities for the control of excess water or storm water.

 

(b)  Authorizes a municipality with a population of 25,000 or less and through which the Bosque River runs to collect from a state agency or public institution of higher education a fee charged for the development or maintenance of programs of facilities for the control of excess water or storm water.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
