AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Each group of newly accredited constables is assigned a unique 48-month training cycle beginning on the first anniversary of completion of the initial training period. The existence of numerous unique training cycles creates unnecessary confusion. Current statute does not provide for a uniform cycle.
H.B. 487 creates a uniform, 48-month continuing education cycle for constables beginning on the first uniform continuing education training period that follows the date that the individual completed the initial training.
RULEMAKING AUTHORITY
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Sections 1701.3545(b) and (d), Occupations Code, as follows:
(b) Requires the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE), by rule, to establish a uniform 48-month continuing education training period.
(d) Requires TCLEOSE, by rule, to establish that the first continuing education training period for an individual under Subsection (b) begins on the first day of the first uniform continuing education training period that follows the date the individual completed the initial training program. Deletes existing text providing that the first 48-month period under Subsection (b) begins, for an individual who completes the initial training program for new constables under this section, on the first anniversary of the date the individual completed the initial training program.
SECTION 2. Requires TCLEOSE by rule to provide an orderly transition for constables to a uniform continuing education training period under Section 1701.3545, Occupations Code, as amended by this Act.
SECTION 3. Effective date: upon passage or September 1, 2007.
