BACKGROUND AND PURPOSE

 

When passing through a new toll road at night, you will see a flash of light as you go through the toll booth.  This is a camera taking a picture of your license plate.  If you did not pay at a booth or use a TX Tag, they will then look up your license plate information and then send you a bill for using the toll lane.

 

This bill specifically says that license plate information gathered manually or by automated enforcement technology can only be used for toll collection, toll collection enforcement and law enforcement purposes.  It also references statute that says that information collected is not admissible as evidence in court except in toll collection enforcement cases.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.   Prohibits using any information obtained from a license plate of a vehicle using a toll project for anything other than toll collection, toll enforcement, or in some instances law enforcement. 

 

If a state-to-state toll project agreement is made that involves the exchange of vehicle registration or license plate information, the agreement must provide that the information may not be used for purposes other than those already mentioned.

 

SECTION 2.  This Act takes effect immediately if it receives a vote of 2/3 of all members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2007.

 

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
