BACKGROUND AND PURPOSE

 

Under current law the court is authorized to dismiss a charge of failure to display valid proof of financial responsibility once the proper documents have been produced.

 

H.B. 588 would allow the court to charge a dismissal fee, not to exceed $10, once the court has verified proof of financial responsibility for the motor vehicle.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

H.B. 588 amends Section 601.193 (b), Transportation Code, by authorizing the court to assess an administrative fee not to exceed $10 upon dismissal of a charge of failure to demonstrate financial responsibility. 

 

Section 51.607, Government Code does not apply to this administrative fee.

 

EFFECTIVE DATE

 

September 1, 2007.
