BACKGROUND AND PURPOSE

 

Currently, local governments cannot build seawalls or street lights as part of public improvement districts, regardless if the citizens are in full support of such improvements. The statute currently authorizes similar projects, but does not include these provisions specifically. 

 

H.B. 673 amends the Local Government Code Section to include seawalls and street lights as authorized projects in a public improvement district.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

H.B. 673 amends the Local Government Code to acknowledge the erection of street lights as an authorized project in a public improvement district as well as the construction or improvement of a seawall, including dredging and backfilling. The bill would also authorize a municipality or county to construct or improve a seawall as a public improvement project on private property if the governing body of the municipality or county finds that the project serves a public purpose of that municipality or county.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
