BACKGROUND AND PURPOSE

 

The Bee Groundwater Conservation District was created in the 75th Regular Legislative Session with the passage of Senate Bill 16 and amended in the 79th Regular Legislative Session by Senate Bill 1799.

 

House Bill 1020 will codify the two enactments into Chapter 8804, Special District Local Laws Code, a nonsubstantive codification of existing code.  There are no changes in the district's authority, director districts, boundaries, operations or funding.  This bill will update the district's current statute with current set of rules for all groundwater conservation districts.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

House Bill 1020 amends Subtitle H, Title 6, of the Special District Local Laws Code by adding Chapter 8804.  The bill will codify the two enactments into Chapter 8804, Special District Local Laws Code, a nonsubstantive codification of existing code.  There are no changes in the district's authority, director districts, boundaries, operations or funding.  This bill will update the district's current statute with current set of rules for all groundwater conservation districts. 

 

House Bill 1020 also contains a validation provision so that all prior acts of the district are validated. 

 

Act takes effect September 1, 2007.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
