BACKGROUND AND PURPOSE

 

Section 521.341 of the Transportation Code provides for the automatic suspension of a driver's license of a person convicted of certain offenses.  Offenses such as criminally negligent homicide, driving while intoxicated, and intoxicated manslaughter are currently listed under this section. The offense of manslaughter, but only in instances where a motor vehicle was used in the commission of the offense, should also result in the automatic suspension of a driver's license upon final conviction.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.   Amends Section 521.341 of the Transportation Code by adding Section 19.04 of the Penal Code, if the offender used a motor vehicle in the commission of the offense, to the list of offenses that require the automatic suspension of a driver's license.

 

SECTION 2.   This Act applies only to an offense committed on or after September 1, 2007.

 

EFFECTIVE DATE

 

September 1, 2007.
