AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under H.B. 2292, enacted in 2003, the Texas Department of State Health Services made a comprehensive adjustment to issued food safety certificates to ensure those certificates lasted for a term of two years.  The increase to two years per term reduced the burden on the state in annual issuance of those certificates.  However, food manager certificates, which had a term of five years, were unintentionally shortened by the legislation.  Restoring the term of a food manager certificate to five years from the two years required by Section 12.0112 (Term of License), Health and Safety Code, may lessen the burden caused by increased certificate issuance.   

 

H.B. 1064 provides that food manager certificates are exempt from Section 12.0112, Health and Safety Code. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 12.0112(b), Health and Safety Code, to include a food manager certificate issued under Subchapter G (Certification of Food Managers), Chapter 438, Health and Safety Code, as a license to which Section 12.0112 (Term of License), Health and Safety Code, does not apply. 

 

SECTION 2.  Effective date: September 1, 2007.
