AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Current statute does not include provisions relating to the transfer of certain records to the new county chair of a political party when a change of leadership takes place.

 

H.B. 1071 requires the person formerly serving as county chair to transfer certain documents to the new county chair and authorizes the former county chair to make copies of those records.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter B, Chapter 171, Election Code, by adding Section 171.028, as follows:

 

Sec. 171.028. COUNTY CHAIR TRANSITION. (a) Requires the person formerly serving as the county chair, not later than the 30th day after the date the term of office of a new county chair begins, to transfer certain accounts and records to the new county chair.

 

(b) Authorizes the person formerly serving as the county chair, before transferring records to a new county chair, to make copies of those records.

 

SECTION 2.  Effective date: upon passage or September 1, 2007.
