BACKGROUND AND PURPOSE

 

Some peace officers are using their rank and officer status in advertisements for their own businesses.  C.S.H.B. 1110 prohibits active peace officers from using their rank and/or status to advertise for a business that the officer owns or manages.  This bill does not affect the ability of an officer to obtain extra employment.

 

RULEMAKING AUTHORITY

 

It is the opinion of the committee that this bill does not expressly grant any additional rulemaking authority to any state officer, department, agency, or institution.

 

ANALYSIS

 

SECTION 1. Adds Subchapter H to Chapter 614, Government Code to prohibit an active peace officer from using the status or rank as a peace officer to promote a business that the officer owns or manages.  Specifies that a peace officer who violates this requirement is subject to disciplinary action by the Texas Commission on Law Enforcement Officer Standards and Education.  Provides that the change in law does not prohibit a peace officer from obtaining private employment on an individual or an independent contractor basis.

 

SECTION 2.  Effective date, September 1, 2007.
