AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
The Texas Lottery Commission (lottery commission) has been reviewed by the Sunset Advisory Commission in each of the previous two legislative sessions. However, these reviews have focused primarily on the issue of gaming expansion in Texas rather than the operation of the lottery commission. This is problematic because the lottery commission has faced management and administrative issues and challenges in recent years. Numerous audits and meetings have been conducted and measures adopted to correct these issues. Given these recent changes, there is value in changing the lottery commission’s Sunset expiration date from 2011, as is currently provided, to 2009.
H.B. 1180 changes the lottery commission's sunset expiration date to September 1, 2009, rather than September 1, 2011, unless continued in existence by the legislature. The bill also deletes expired text providing that the lottery division is subject to Chapter 325 (Texas Sunset Act), Government Code.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 467.002, Government Code, to change the sunset date of the Texas Lottery Commission to September 1, 2009, rather than September 1, 2011.
SECTION 2. Amends Section 466.003, Government Code, as follows:
Sec. 466.003. New heading: CONTINUATION OF LOTTERY OPERATOR CONTRACT ON ABOLITION OF COMMISSION. Deletes existing text relating to a review by the Sunset Advisory Commission under Chapter 325 (Texas Sunset Act) of the recommendations made by the 78th Legislature and a previous sunset date of September 1, 2005. Makes a conforming change.
SECTION 3. Effective date: upon passage or the 91st day after adjournment.
