BACKGROUND AND PURPOSE

 

Under current law, the Texas Lottery Commission is subject to Chapter 325 (Texas Sunset Act), unless continued in existence, the commission is abolished, and the chapters expire September 1, 2011. 

 

The Lottery Commission has undergone a review by the Sunset Commission in each of the previous two sessions, including the 78th and 79th Legislatures. However, the reviews have primarily focused on the issue of gaming expansion in Texas and not on the operation of the organization.

 

With respect to the organization's operations, in recent years, the Lottery Commission has faced some management and administrative issues and challenges. During this period, numerous audits and meetings were conducted and measures were adopted to correct these issues. Given the recent changes, there will be value in having the expiration date moved from 2011 to 2009.

 

HB 1180 will move up the Lottery Commission's sunset review date by changing the Lottery Commission's expiration date, unless continued in existence, to September 1, 2009 instead of September 1, 2011 and deletes an expired section.  

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

 

ANALYSIS

 

HB 1180 will change the Lottery Commission's expiration date, unless the agency continues in existence, from September 1, 2011 to September 1, 2009,  The bill also amends Sec. 466.003, Government Code, by deleting an expired section and renaming the section accordingly. 

 

 

EFFECTIVE DATE

 

Immediately, or, if the Act does not receive the necessary vote, the Act takes effect on the 91st day after the last day of the legislative session.
