BACKGROUND AND PURPOSE

 

Current law does not provide direction to a county clerk with respect time and date notation for an instrument recorded electronically. The purpose of this bill is to provide permission to make such notation on an electronic record.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill would amend Section 193.001(b) of the Local Government Code by adding a clause stating that if an instrument is recorded electronically, the clerk may note recording information, including date and time, on the first page.

 

EFFECTIVE DATE

 

Immediately on receipt of required vote, otherwise September 1, 2007.
