AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Currently, the Stonewall County Hospital District (district) board of directors (board) terms are not staggered and are not consistent with Election Code timelines.   H.B. 1298 provides for the election of the board for staggered three-year terms and requires the district to follow Election Code timelines for ordering an election and publishing notice of the election.  

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Sections 3(a) and (c), Chapter 54, Acts of the 58th Legislature, Regular Session, 1963, as follows:

 

(a)  Provides that the Stonewall County Hospital District (district) is governed by a board of five directors elected at large by place for staggered three-year terms.  Deletes existing text relating to the election and terms of the district's board of directors.

 

(c)  Requires the board of directors of the district (board of directors) to order a regular election of directors to be held each year on the May uniform election date under Section 41.001 (Uniform Election Dates), Election Code, rather than the first Saturday in May of each year.  Requires the board of directors to issue the order in accordance with Chapter 3 (Ordering Election), Election Code.  Requires the notice of the election to be published in a newspaper of general circulation in the district in accordance with Section 4.003 (Method of Giving Notice), Election Code, rather than one (1) time at least ten (10) days prior to the date of election.  Requires any person desiring that person's name to be printed on the ballot as a candidate for director to file an application with the secretary of the board of directors of the district in accordance with Section 144.005 (Filing Deadline), Election Code, rather than at least 31 days prior to the date of election.  Deletes existing text relating to the timeline for issuance of an election order and the information that order is required to contain.  Makes a nonsubstantive change. 

 

SECTION 2.  Sets forth the procedures for selecting place numbers and length of terms for board members serving on the effective date of this Act.  

 

SECTION 3.  Effective date: upon passage or September 1, 2007.
