BACKGROUND AND PURPOSE

 

The current felony prosecutor supplement fund exists to provide longevity pay to certain prosecutors. The purpose of the bill is to expand the coverage of this fund to certain assistant county prosecutors not currently covered and to rename the fund.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill would redefine an assistant prosecutor under Section 41.251 (1) of the Government Code by removing the current restriction to assistant county attorneys compensated by the state to perform the duties of a district attorney, with the result that all assistant county attorneys would meet the definition.

 

The bill would rename the felony prosecutor supplement fund the assistant prosecutor supplement fund.

 

The bill would also renumber an item in the list of fees and costs set forth in Section 103.022 of the Government Code to address the fact that two differing subsections currently carry the same number as a result of amendments enacted by the 79th Legislature.
