BACKGROUND AND PURPOSE

 

Junior college districts in Texas have specified service areas.  HB 1374 would expand the service area of the Amarillo College District to include all of Moore County, and would take that portion of   Moore County that is currently served by Borger Junior College District out of Borger Junior College District's service area. 

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1:  Section 130.164 of the Education Code is amended by adding Moore county to the list of counties in the Amarillo College District service area. 

 

SECTION 2:  Section 130.169 of the Education Code is amended by eliminating the area in Moore county that is currently a part of the service area of Borger Junior College District from the service area of the Borger Junior College District.

 

SECTION 3:  The change in law made by this Act applies beginning with the 2007 fall semester, except that during the 2007-2008 academic year the Borger Junior College District may continue to treat the area removed by this Act from the district's service area as if the area were still in the district's service area as necessary to avoid an unreasonable interruption of junior college services in the area.

 

SECTION 4:  Effective date.

 

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2007.
