BACKGROUND AND PURPOSE

 

The 147th District Court in Travis County currently has the duty to empanel grand juries for each term of court. The purpose of the bill is to remove this requirement and make the empanelling of a grand jury discretionary.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill removes the duty of the 147th District Court to empanel grand juries by deleting the exception language in Section 24.155(d) of the Government Code and repealing Section 24.248(c) of the Government Code. The bill also changes the terms of court for the 147th and 167th district courts.

 

EFFECTIVE DATE

 

Immediately on receipt of required vote; otherwise September 1, 2007.
