AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Harris County Municipal Utility District No. 402 (district) encompasses an area outside of the corporate limits of any city and within the extraterritorial jurisdiction of The City of Houston. The land located within the district is single family residential and commercial development and is in need of road services.

 

H.B. 1401 authorizes the district to impose taxes, issue bonds and obligations, and use eminent domain to provide road services to the district.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle F, Title 6, Special District Local Laws Code, by adding Chapter 8198, as follows:

 

CHAPTER 8198. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 402

 

Sets forth standard language granting additional authority to the Harris County Municipal Utility District No. 402 (district). Sets forth standards, procedures, requirements, and criteria for:

 

General provisions (Sections 8198.001-8198.050);

 

Powers and duties of the district, including authority relating to road projects (Sections 8198.051-8198.100); and

 

General financial provisions and authority to impose a tax and issue bonds and obligations for the district (Section 8198.101-8198.151).

 

Authorizes the use of eminent domain by the district.

 

SECTION 2. Provides that all requirement of the constitution and the laws of this state and the rules and procedures of the legislature with respect to the notice, introduction, and passage of this Act are fulfilled and accomplished.

 

SECTION 3. Effective date: September 1, 2007.
