AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, Section 26.303 (Handling and Disposal of Poultry Carcasses), Water Code, allows poultry carcasses to be disposed of as swine food, but Section 165.026 (Feeding Garbage to Swine), Agriculture Code, prohibits that use.
H.B. 1457 rectifies the conflicting statutes by amending the Water Code and striking disposal of poultry carcasses as feed for swine. The bill also prohibits the storage of unfrozen poultry carcasses on the site of a poultry facility for more than 72 hours.
RULEMAKING AUTHORITY
Rulemaking authority previously granted to the Texas Natural Resource Conservation Commission [Texas Commission on Environmental Quality] is modified in SECTION 1 (Section 26.303, Water Code).
SECTION BY SECTION ANALYSIS
[While the statutory reference in this bill is to the Texas Natural Resource Conservation Commission (TNRCC), the following amendments affect the Texas Commission on Environmental Quality, as the successor agency to TNRCC.]
SECTION 1. Amends Section 26.303(a), Water Code, to require the rules adopted by TNRCC governing disposal of poultry carcasses to prohibit the storage of unfrozen poultry carcasses, rather than any poultry carcasses, on the site of a poultry facility for more than 72 hours. Redesignates existing Subsection (h) to Subsection (g). Deletes existing text related to the disposal of poultry carcasses for the use of cooking for swine food.
SECTION 2. Effective date: September 1, 2007.
