BACKGROUND AND PURPOSE

 

There are circumstances in which it is advisable to certify a guardian on a provisional basis. The purpose of this bill is to provide statutory authority for such certifications.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that rulemaking authority is expressly granted to the Supreme Court of Texas in SECTION 2 of this bill. 

 

ANALYSIS

 

The bill would amend Chapter 111, Government Code by adding provisions permitting, and setting the requirements for, provisional certification of persons meeting supreme court qualifications but not the qualifications of Government Code Section 111.042.

 

EFFECTIVE DATE

 

Immediately on receipt of required vote; otherwise September 1, 2007.
